Summary/Abstract: The article is dedicated to the prohibition for reformatio in pejus in criminal procedure and considers issues that may occur in the determination of that prohibition in the different stages of criminal proceedings. The proper resolution of such issues is a precondition for courts to decree correct and legal verdicts and sentences when they apply judicial review. No less important is the fact that prohibition for reformatio in pejus of the defendant offers a guarantee to achieve his/ her claim of vindication. That is why the prohibition for reformatio in pejus is so important in relation to the fairness of court proceedings in criminal matters and for accordance o the Bulgarian criminal procedure to the requirements which are set by the European standards before the justice system. Working on this article I was looking to examine in the most condensed form issues which are covered by the prohibition of reformatio in pejus in the different stages of criminal proceedings. As a starting point, I used the guiding instructions referred to in the practice of the Supreme Court of Cassation and research in legal doctrine about the prohibition for reformatio in pejus.
