Summary/Abstract: This paper critically analyzes the various conceptual approaches to the modern state. By exposing the conceptual shortcomings of Weber’s approach to the state, the focus shifts from the state as a creator of rules and its exclusive use of violence for the sake of obedience to state decisions on the many forms of interaction of multiple separate systems that are typical for every human society. In this sense, the state has limited autonomy, which is not fixed. Respecting the division of the despotic and infrastructural power of the state, the work also analyzes the relationship between state capacity and democracy, the relationship between the state, political and administrative capacity, the impact of globalization on state capacity and sovereignty, and, finally, analyzing importance of vertical and horizontal legitimacy for the classification on weak and strong states .The paper concludes with emphasis on mutually empowering relationship between the level of state capacity and democracy, with the affirmation of the role of state in the era of globalization and the positioning of the state– society relations as essential to understanding the state action.
