About the freedom of construction de lege lata and de lege ferenda

Summary/Abstract: The concept of the freedom of construction is one of the key issues raised in the discussion about the current and future regulations of the investment and construction process. The Author makes some remarks on the freedom of construction because of doubts concerning the correctness of its perception from the legal point of view. What is more, the first results of the work on the draft of the Code on urban planning and construction provide a basis for determining the direction of the outlined proposals of normative solutions and provoke the reflection on the future content of the freedom of construction.
