Controversies concerning port customs in Polish practice

Summary/Abstract: The article is devoted to the issue of port customs rarely undertaken in Polish literature. The Author distinguishes between a custom and customary law and discusses the importance of customs in the Polish legal system, in particular in the law of the sea. Most considerations is devoted to the system of the publication of port customs in Poland, including the role of the Commission of Port Customs of the Polish Chamber of Maritime Commerce. Critical analyze is concerns the document “Principles of the Cooperation between Participants of Maritime and Port Trade in Polish Seaports” prepared by the Commission.
