Transmission easement on property managed by nationaL Forests – a gap in the law or a new limited right in rem

Summary/Abstract: The legal regulation regarding the transmission easement in the Act on Forests may constitute grounds to assess the quality of legislative processes applying the concept of a rational legislator. Creating the content of Art. 39 a of the Act on Forests the legislator showed incomplete knowledge of the current legal status. The lack of a provision directing to the provisions of the Civil Code is a defect of the regulations of the Act on Forests, which creates the problems of interpretation on the basis of language interpretation. The Author has presented the outcome of the interpretation based on derivative concept allowing to solve the problems of interpretation.
