Summary/Abstract: The leak of oil from the Deep water Horizon rig and the down hole in the Gulf of Mexico in 2010 is considered to be the greatest environmental disaster in the United States, exceeding in size the spill from the tanker Exxon Vladez in 1989. The damages of catastrophic nature, such as that caused by the leakage in the Gulf of Mexico, are always accompanied by the problem of adequate compensation. In the United States of America the law regulating liability for damage caused by oil spills, including oil rigs and pipelines, has been operating since 1990. The Author discusses in detail the Oil Pollution Act (OPA) as far as it governs the liability for damage caused by oil spills from equipment, shows the effects of the application of the OPA to the leak in 2010, focuses on the controversial issues of the remuneration of the so called pure economic and environmental damage and discusses the issue of the quota limitation of the liability of those responsible on the basis of the OPA.
