Le régime juridique des étrangers en situation irrégulière devant la Cour constitutionnelle

Summary/Abstract: Although the Constitution guarantees human rights to foreigners, their legal regime varies according to the different categories established by the legislator. Illegal immigrants remain the most vulnerable category of foreigners. The case law of the Romanian Constitutional Court has consistently protected the discretionary power of the legislator in this area, even at the cost of a certain relativity of fundamental rights of aliens, in particular their right to individual liberty and freedom of movement.
