Commencement and expanding of the criminal investigation in rem and in personam. The competence limits of the investigation body of the judicial police and the prosecutor in the sense of the new criminal procedure Code

Summary/Abstract: The article points out the distinction between the commencement of the criminal investigation regarding the act – known in the legal doctrine as in rem – and the criminal investigation regarding a person ¬– in personam – that the current Code does, unlike the old criminal procedure Code. There are presented the cases that prevent the initiation and exercising of the criminal proceedings, the prosecution acts that can be done after the commencement of the criminal investigation in rem, the activities that can be done only in the criminal investigation in personam stage, the expanding of the criminal investigation or changing the legal classification of the facts and the initiation of the criminal proceedings.
