Main principles given by the Constitutional Court through Decision no. 405/2016 regarding abuse in office

Summary/Abstract: The present article presents the main consequences of Decision no. 405/2016 of the Constitutional Court of Romania regarding the content of the crime of „abuse in office” as it is regulated by the Criminal Code and by Law no. 78/2000. The article gives special consideraton to the paragraphs of the Deicison of the Constitutional Court referring to the characteristics of guilt necessary to trigger criminal responsibility and the objective content of the crime (the meaning of the notion of „action”, „in an improper way”, „undue benefit”).
