Summary/Abstract: A claim against a third party is incompatible with the special procedure regulated by the E.G.O. n. 66/2011 on the prevention, identification and sanctioning of the irregularities occurred in the collection and use of the European funds and/or national public related funds. The rules of common law are, in this case, incompatible with the provisions provided by the special regulations, which refer to the prevention, identification of the irregularities and recovery of budgetary debts resulting from the irregularities occurred in the collection and use of the European funds and/or of the national public related funds, as well as reporting the irregularities to the European Commission or to other international donors. These activities are performed in accordance with the special procedure regulated by E.G.O. n. 66/2011, by the competent authorities, carrying out their administrative functions, in accordance with the provisions of E.G.O. n. 66/2011, in order to extinguish budget debts resulting from irregularities.
