The determination of the inheritance reserve depending on renunciators of inheritance who have been gratified by a reportable donation

Summary/Abstract: The article brings to the fore an issue that refers to the situation of those successors of the deceased, potential heirs (descendants and surviving spouse, which come in competition with the descendants) who have been gratified by a reportable donation and wish to renounce an inheritance to keep the donation. The article answers the question of whether to establish the inheritance reserve it will be taken account of them or not, being first analyzed the situation under the rule of the Civil Code of 1864 and then in the current regulation.
