Summary/Abstract: Among the issues raised by incriminating simple bankruptcy and fraudulent bankruptcy, the new Criminal Code also comprise those related to the introduction of procedural condition, meaning that, unlike the old law, for both offences, criminal proceedings shall be initiated on prior complaint of the injured person. Two debatable issues can be identified in relation to this legislative change: the first refers to transitional situations, and the second refers to the person entitled to file a prior complaint.
