The Liability of Online News Portals for the Comments of their Readers

Summary/Abstract: The judgment of the European Court of Human Rights in Delfi v Estonia enshrines a solution for the issues raised by freedom of speech that touches upon the dignity of a person in the context of anonymous speech on the Internet and the liability of an online news portal for the comments posted by readers. The European judge decided that there are situations in which the news portal is liable when an anonymous commenter touches upon the dignity of a person. The paper contains a summary of the Delfi case and a short analysis of the arguments of the Court.
