Legal Restrictions in Spa Protection Zones. Selected Issues

Summary/Abstract: The article presents the problematics of legal restrictions in spa protection zones, which are fixed since so called spa act is in force. In each zone, that are defined by letters “A”, “B” and “C” some prohibitions connected with e.g. investments, building some objects, trading, farming are introduced. Additionally, the legislator decides what use of each zone should be and sets some positive demands related to this aspect such as need of maintain a minimal percentage of green area. The limitations are varied as for their intensiveness, from the most restrictive in “A” zone, that is designed for spa purposes to the less intense in “C” zone, that functions as a surrounding of other zones. In the article legal status in this aspect was shown, including both former and present regulations. Some practical problems that appear in relation to applying law were also taken into consideration; legal jurisdiction and postulates de lege ferenda were also analyzed. It allowed to appraise the idea of spa protection zones and to try answer the question whether discussed restrictions are essential and adequate.
