SOME PROBLEMS IN RELATION TO THE ELIGIBILITY AND EXCLUSION OF TRANSFERRING RIGHTS FROM PRIOR ART CONTRACT

Summary/Abstract: With the present article are analyzed some of the methods for the transfer of rights from a preliminary contract according to art.19 OCL. These modes are also analyzed regarding their admissibility to transfer rights from a preliminary contract according to the issues of art.99.1 OCL and specific nature of rights from the preliminary contract. The subject of this article is also the nature of the rights from a preliminary contract regarding the subject of the contract used to transfer such rights. The present article analyzes the Supreme Court practice regarding the above mentioned subject, as well as criticizes some of the methods which are unlawfully used for the transfer of rights from a preliminary contract.
