Coordination of Social Security in Relation to Third-Country-Nationals – Are We Equal?

Summary/Abstract: The paper tries to answer a fundamental question about equality from the point of view of third-country-nationals and their social rights. It looks not only into coordination regulations, but also into free movement rules. Basic recent case-law of CJEU and ECHR is presented and discussed, whereas some proposals for changes are deduced from conclusions of the respective courts. The author concludes, that coordination rules as such are hardly missusable by third-country-nationals and that in current situation in the world, with consequences for Europe, there is probably a right time to change the European attitude towards immigrants, including a re-thinking of their social rights.
