Notes on the legal capacity of homeowner associations (in the light of the judgement of the Supreme Court of Poland of 26 June 2015, I CSK 312/14)

Summary/Abstract: This article examines the extent of the legal capacity of a homeowner association, in the light of the most recent judicial decisions. It presents a critical analysis of the view ofthe unlimited legal capacity of a homeowner association which is said to have exceededthe legal relationship resulting from the management of the real property common to the owners of individual premises.
