Summary/Abstract: In this study, the authors address a current and highly sensitive topic, namely the extended confiscation. The analysis is based on the Law 63/2012 which introduces provisions relating to the new criminal sanction both in the Criminal Code in force and the new Criminal Code (Law no. 286/2009). The article also looks at the steps the draft legislation has been through, explaining the legislator’s various option changes during the adoption process.
