Principles and rules for determination of the penalty

Summary/Abstract: The principles of justice, legality, guilt, humanism and equality are specified in the rules for determination of the penalty. The court has the right to stay assured that while following the rules the penalty shall also follow the principles. In order to achieve this, the principle of justice shall lose many of its features as abstract category; the principles of guilt and equality shall be fully implemented in the legal acts, and to the rules for determination of the penalty shall be added new ones which define a tighter zone of legitimate sanction options.
