Summary/Abstract: The New Romanian Civil Code introduces the landlord’s legal obligation to maintain the property safe and free from health hazards (implied warranty of habitability). The present article offers an analysis of the concept of housing safety and also presents the historical evolution of the regulations surrounding this concept from the standpoint of two legal systems, the civil law and common law legal system.
