Summary/Abstract: This article requires to come out from the phenomenon of fundamentalization of human rights in the process of definition the nature of the right to a fair trial. The author understands it like human rights evolution which led to human birth facilities acknowledgement as the fundamental rights with international guarantees of their implementation and legal defense. The fundamentalization of human rights evolved gradually in four stages: human rights conceptualization, human rights constitutionalization on the national level, international and regional institutionalization which led not only to fundamental rights value confirmation on the supranational level and their substance universal understanding as well as to the creation of the efficient international mechanism which permits to protect these rights on the governmental level as well as on supranational level in case of some government deviation to implement the committed international liabilities. It is substantiated in this work that as the consequence of fundamentalization of human rights the right to a fair trial was transformed from the right-privilege which contained the justice access and court trial with proper judicial procedure compliance, to the fundamental right which is universal human right standard that includes the dynamic system of procedural guarantee and is recognized as the element of law supremacy principle. Hence the author concludes that the fundamentalization of human rights is the methodological concept of the right to a fair trial.
