Summary/Abstract: Waiver of penalty, as a new institution under the Romanian Criminal Law, but traditional in other national legal systems, aims to provide courts an additional judicial individualization form of criminal sanctions. Thereby, the court may exempt from criminal liability those who have committed less serious offences, on account of special penalty limits, its commission method and purpose, as well as when the person of the offender gives trust to the judicial body on having realized the importance of social values, that he is required not to violate again in the future.
