Summary/Abstract: The paper scrutinizes provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms dealing with reasons for ordering and extending detention. It specifically highlights the importance of the European Court of Human Rights whose decisions demonstrate the true meaning of the Convention’s provisions. Reasons for detentions, in accordance with the European Convention are: suspicion of fleeing, potential obstruction of the proceedings, prevention of committing a crime, maintenance of public order, along with risk of transgressing judicial orders and violation of law. Special consideration is given to each of the aforementioned detention reasons with insight on the implementation scope of these procedural legal concepts.
