Summary/Abstract: The right to property was the most contested, but now the right to property in Bosnia and Herzegovina has become entitled to the highest respect. One reason for that is his constitutional protection. This right is protected in BiH in Annex 4 (Constitution of BiH) and Annex 7 of the General Framework Agreement for Peace in Bosnia and Herzegovina. Due to the status of the European Convention for the Protection of Human Rights and Fundamental Freedoms in the legal system of BiH, the right to property is protected by the present Convention and its Protocol No. 1. In particular, the importance of the European Convention and the European Court of Human Rights, we can see in the decisions of the Constitutional Court of Bosnia and Herzegovina when deciding on the protection of right to property. In addition to the Constitutional Court, a major role in protecting of this right was played by the Commission for Displaced Persons and Refugees.
