Summary/Abstract: One of the most controversial aspects of European and national regulations on asylum and immigration is armed with the possibility of placing in detention ("public custody", according to the regulations of Romania) to applicants for international protection. In a series of recent judgments the CJEU circumstantiates recourse to this procedure, which requires a re-examination of national law and domestic judicial practice.
