Summary/Abstract: The content of the individual employment contract includes general rights and obligations of the parties. Thus, on one hand the employer is bound to ensure the provision of the agreed activities and also provide the employee with the means to perform it, on the other hand the employee must perform work personally, being in a subordinate position. The main rights and obligations of the employees are mentioned in art. 39 (p. 1 and p. 2) of the Labor Code. The Labor Code also establishes in art. 40 p.2 the main obligations of the employer and lists the basic rights of the employer under their contractual relationship with the employee. Besides the general clauses of the individual employment contract, the contents of the parties may include specific clauses, some of them being covered by the Labor Code, other by special laws.
