Summary/Abstract: The right to respect for family life is guaranteed by Article 8 of European Convention on Human Rights. The meaning of the term “family life” it’s very hard to determine, but the European Court of Human Rights in Strasbourg in the judgments made certain criteria. Because of that it could be said that the practice of this Court actually shaped this concept. On the circumstances of each case will depend on the extent to which the applicant will be able to invoke the protection of the right to family life. In addition, as shown in this paper, a family life not only provides protection to families based on marriage, but other de facto communities that are manifest through life together or otherwise. Domain of application of the right to family life is presented in this paper through the relevant case law of the European Court of Human rights.
