Summary/Abstract: The paper has three parts. The first one is introductory, where the author explains why there is a primacy of international law. In the second part of the article he answers the most common arguments that challenge this primacy. In the third, concluding part the author notes the existence of another very important problem, which consists in the request that in order to have legitime primacy, international law must be democratic, one that suits the interests of all members of the international community and not a law that could be turned into an instrument of political and other domination of the most powerful nations.
