Summary/Abstract: Ever since it has been established the sentence of imprisonment has been disputed many times. The rise of recidivist crimes has only confirmed the limited power of imprisonment and the failure of the idea of resocialization, which has also conditioned the reexamining of both the punishment and the manner of its implementation. In an attempt to modify the sentence of imprisonment many countries have started to include private sector in its implementation, while in some countries the governments have gone so far as to give the charge of penal facilities to private companies. It is this form of privatization of punishment that arouses the highest controversy in expert public as well as its actual implementation and this is why the special attention should be given to its description.
