Summary/Abstract: The institution of exclusion of economic operator from procedure of awarding public procurement has been governed in article 24 of act Public Procurement Law passed on 29th January 2004 (hereinafter called as “p.z.p.”). The purpose of the above mentioned institution is effective spending of public funds is to prevent such situation in which public procurement will be awarded to the contractor that in respect of any of the attribute does not guarantee the proper performance of a public contract. The purpose of this elaboration is presentation of circumstances justifying the exclusion of contractor from the awarding of a public contract. The Author of this elaboration subject considerations leads in light of the changes introduced by the Act of 12th October 2012 amending the Act – Public Procurement Law and the Law on concessions for works or services, which came into force on 20th February 2013. The Institution of exclusion of the contractor from procedure of awarding public procurement seems to be interesting both from an academic point of view, as well as the practical application of the law.
