Summary/Abstract: Law theory usually admits that the Constitutional Courts jurisprudence stands as a source of law. This impression is backed by 147th article of the Romanian Constitution, which states that after the decisions of the Constitutional Court are published, they stand as definitive and mandatory. Embracing this conclusion, we will present how it is reflected in business law. In essence, we treat a series of decisions of the Constitutional Court which influenced and continue to influence this branch of the law, adapting or correcting where the Parliament failed to do so.
