The Balance between Freedom of Expression and Copyright Protection in Showbusiness

Summary/Abstract: In the paper under discussion are two broadcasts of fragments from “Slavi’s Show” (from its editions broadcasted on September, 22 and September, 25, 2009) in two editions of the TV show “Masters of the Aif’ (from its editions broadcasted on 14.10.2009 and 21.10.2009). According to the author, the above- mentioned quotations are critical according to the Law on Copyright and Related Rights in the performances of others in broadcasts of “Slavi’s Show”. The broadcasted fragments from another TV show correspond with the general practice in Bulgaria and all around the world which is adopted in the use of quotations from works already disclosed to others for the purposes of criticism. They contain the source (television broadcast which is discussed) and the broadcaster’s logo which is the media service provider. They have been used to the extent which justified the purpose. The balance between freedom of expression and the protection of copyright is respected in favour of freedom of the artistic creativity and audience access to the cultural values.126
