Summary/Abstract: The present report contains a brief outline of ECJ’s jurisprudence on the application of the ‘national identity clause’ (Art. 4, paragraph 2 TEU) within the context of collisions between market freedoms and fundamental rights, which are subject to specific protection in Member State’s constitutional law.
