Legal Condition of the joint venture in the new Civil Code

Summary/Abstract: The present article deals with the possibility of cooperation in economic activity through the institution of the joint venture, association without legal personality currently regularized by art. 1949-1954 Civil Code. The importance of the approached topic is that, in this century, where the relations between professionals gained a special scale, being characterized by an exponential increase of relations with foreign element, the existence of institutions that allow cooperation which is not subject to bureaucratic formalism is auspicious, the legislator being the one who should bring under regulation this institution of law in such a way that the legal frame and the security of relations between professionals to be ensured both between parties, but also regarding third parties.
