Penalizing Business Law. View on Criminal Liability of Legal Persons

Summary/Abstract: This study offers a broad picture of the criminal liability of legal persons, as provided by the new Romanian Criminal Code, starting from the conditions of engaging such liability and going to the applicable penalties and to the causes which prevent criminal liability and enforcement of sanctions. The author presents in detail the opinions expressed in the legal literature and, where existing, solutions offered by the case law regarding the most important problems in this field, such as the possibility to engage liability of legal persons as author for crimes having a qualified subject or the possibility to cumulate the quality of defendant and that of civil liable person.
