Summary/Abstract: The study is an analysis of Article 239 of the Criminal Code, which contains two distinct offenses, the criminalization in para. (2) being not an assimilated version of the one in para. (1). Both offenses sanction the debtor’s illicit behaviour, attempting to frustrate the creditor's ability to satisfy his claim against him through a forced execution procedure.
