Summary/Abstract: Subject: Discrimination on criteria of religious by issuing GEO no. 114/2013 The complainants considered that the Hungarian minority is subject of discrimination based on religious criteria by issuing GEO no. 114/2013, under which he was awarded the Romanian Orthodox Episcopate of Covasna and Harghita with the hotel complex Bradul of Covasna. NCCD terms: Saying about the Romanian Orthodox Church that is a fundamental institution of the Romanian state which plays a key role in defending the national identity of the Romanian people, therefore must be assigned certain emergency immovable because "adopting measures proposed in this emergency ordinance will generate negative effects, embodied in failure role and functions of the basic institutions of the Romanian state", is a public behavior that creates an atmosphere hostile to people of other faiths than the Orthodox Romanian. We believe that the preamble O.U.G. no. 114/2013 contains discriminatory elements, contrary to the provisions of GO no. 137/2000; also the practice of granting to use immovable property exclusively to a single cult, and not to other religions, in proportion, if any request therefor, is discrimination according to art. 2 para. (1) O.G. no. 137/2000. To avoid discrimination, the buildings in question, owned by the State Secretariat for Religious Affairs should be given not for the exclusive use by a single cult, but to the alternative use of all denominations recognized by law.
