Summary/Abstract: According to the legal definition in art. 431 Civil Code, an entrepreneur is a natural person, a legal person or an organizational unit referred to in article 331 § 1 conducting business or professional activity on its own behalf. Non-profit organizations such as: foundations, associations, labor unions, political parties, religion unions are not entrepreneurs as they conduct non-commercial activities. However, these organizations can also become a subject of entrepreneurs rules, if they conduct, even accessory, business activity. Their identification name becomes a firm (business name). Based on the example of associations and foundations this article presents legal frame for changing the name of the third sector organization into firm. The necessity of connecting the right to firm protection only with actual conducting of business activity has been emphasized.
