Summary/Abstract: Shaping the company's name is one of the elements that entity starting a business in the form of commercial law must specify in the basic act. The existing provisions of the Polish law and the law of the United Kingdom shape of freedom of choice of the company name in a different way. The aim of this article is to show if the Polish legislator gives the parties starting their business in the form of commercial companies the right to freely choose the name of the company, and if so, to what extent, in comparison with the English legislator and whether such a solution is appropriate in light of trading practices. In this paper the formal - dogmatic and com-parative legal methods were used, resulting in the analysis of subjected provisions of Polish and English law in shaping freedom of naming the companies. The author has adopted the research hypothesis that the Polish legislator treated the freedom to create the names of commercial companies in a wider way than the legislator wider in the UK in the Companies Act of 2006.
