Summary/Abstract: The regulations of the so-called “major amendment” of the acts of law concerning copyright and cognate acts of law have been binding since January 2016. The changes concern inter alia the extension of fair use, which enables everyone to use public speeches, lectures or sermons within the limits of the justified use of information (Art. 261 of the law concerning copyright); fair education-related use (Art. 27 of the law concerning copyright) which stipulates that educational institutions, institutions of higher education, scholarly and scientific research units, scholarly institutes of the Polish Academy of Sciences, museums (if they offer PhD studies, post-doctoral studies or other forms of education), are entitled – for the purpose of instruction or research – to use the works which are disseminated in the original form and in the translated form and to multiply brief woks or fragments of greater works in the process of instruction. Fair education-based use facilitates the use of e-learning by educational institutions (on condition that the participants of the courses are not anonymous). The amended act of law contains a number of regulations which are relevant from the point of view of librarians, e.g. the payout of remuneration to the authors, lending copies of works by public libraries (public lending right); the use of orphaned works and of works which are not circulated in trade, works which are a part of the collections of the institutes of culture and education such as archives, libraries and museums.
