Summary/Abstract: The paper examines aspects regarding the use of musical works in theatre performances as defined by Romanian law. Although there is an extensive legal framework dedicated to this problem, there are still contradicting reglementations and practical aspects that resulted in an outburst of legal cases concerning copyright infringments. Moreover, after years of cases trialed, the debate is still not settled in every aspect. An explication to this controversy could be the fact that in some fields, a legal solution, unanimously accepted as benefitting authors, still hasn’t been found. It is our belief that the current practice is contrary even to this particular interest. The paper presents the legal framework referring to the use of musical works in theatre performances, as well as the most frequent problems that often result in lawsuits in the practice of collecting societies. Lastly, the case of Circul Globus vs UCMR-ADA will be presented as an example of multiple options regarding interpretations, and also, a flagship case regarding the handling of musical works by collective societies.
