Summary/Abstract: One of the obvious present-day challenges to human rights law is their applicability in times of war, which is the topic of this paper. The author argues that human rights norms and humanitarian norms do not exclude each other. In holding so, the author tries to explicate the applicability of human rights norms in times of war according to the stipulated provisions of human rights treaties. Therefore, the author argues that the human rights instruments apply in times of war and explains this thesis with the fact that these instruments provide the possibility of derogation of certain human rights in situations of emergency or necessity.
