A CRIMINAL LAW APPROACH TO SUICIDE

Summary/Abstract: The idea of the authonomy of will re-gains its relevance in the modern societies. The same goes for the concept of the right to self-determination, according to which every individual is the master not only of their body, but also of their life. The right of individual to make autonomous decisions regarding their living includes not only the right to life, but also the right to death. Human right to life is recognized in present times beyond any doubt, and from the right to life derives the right of each individual to take their own life, that is to decide on ending it. However, while the right to life has been recognized as the most important human right, acknowledged without any reserve in the modern societies, and guaranteed by numerous international and national documents, the right to death is entering the legal space very slowly. The main purpose of this article is to offer legal analysis of this controversial issue. The author scrutinizes provisions of the Penal Code of the Republic of Croatia, as well as some historical legal sources, in respect of suicide, attempted suicide and physician-assisted suicide.
