Summary/Abstract: The paper discusses two contentious German contributions to the CISG. The first issue is the so-called reasonable-use test which is applied as part of the fundamental breach doctrine. The second issue is an intricate doctrinal debate about the relationship between the right to avoid the contract and the right to claim damages for the performance interest.
