Evolution of the Regulation Regarding the Evocation of the Fund by the Appelate Court in Civil Matters

Summary/Abstract: Beginning with Law no. 59/1993, the Romanian legislator has looked for appropriate legal solutions in order to ensure parties rights, by regulating rules that ensure double jurisdiction in civil matters, on one side, and the celerity of proceedings in civil cases. The article analyses the evolution of this legislation, the decisions of the Supreme Court regarding these issues and comments the current legislation provided by the new Code of Civil Procedure.
