Summary/Abstract: The article proposes issues of law and civil rights from the standpoint of other approaches and approaches of contemporary Western Marxist theories. Analysis led by sources of Marxist law theory, by Althuser theoretical perceptions of law, with attention to the positions of Jurgen Habermas and Edward Palmer Thompson and their criticism by Western Marxists. The narrative of this favor is Paul Hirst and is an approach to the law and the meaning of Marxism in the field of law in socialism. The comparison is made by Jurgen Habermas and Evgeni Bronislavovich Pashukanis. Make early the challenges for the theory of law, including civil rights and criminology from the approach of Western Marxist theories.
