Advisory Committee of the Framework Convention for the Protection of National Minorities: Thematic Commentary no. 4 on the Scope of Application of the Framework Convention

Summary/Abstract: In the process of implementation of the Framework Convention for the Protection of National Minorities, alongside the country specific opinions, the Advisory Committee has also developed, after the first monitoring cycle, a working method with a cross-cutting approach. Thus, in 2004, the Committee has launched his work on thematic issues, which aims at synthesizing the Committee's experience and opinions on the most important issues which it has come across in the monitoring process. The material result of this work is the adoption of the thematic commentaries. So far, the Committee has adopted four such thematic commentaries, namely: Thematic Commentary no. 1 on Education (2006), Thematic Commentary no. 2 on Participation (2008), Thematic Commentary no. 3 on Language Rights (2012) and Thematic Commentary no. 4 on the Scope of the Framework Convention for the Protection of National Minorities (2016). The last one, the Thematic Commentary no. 4 on the scope of the Framework Convention for the Protection of National Minorities, adopted in 2016, is an ample document covering the scope of the provisions of the treaty mentioned in two respects, namely: in personal terms (that of the recipients of its provisions) and materially (that is, that of the applicable provisions).
