Summary/Abstract: Due to the nature of urgent measures is necessary to bear in mind the question of proportionality to avoid the violation of the right to a fair trial during creating effective protection. The contribution goes through the news related to the new Civil Procedure Code, but especially by ordering urgent measures in matters of industrial property, in which can be violated the right to a fair trial in accordance with judicial decisions.
