To the parties and the status of the descendants in the affiliation and denial of paternity proceedings

Summary/Abstract: This essay deals with the issue of parties in the affiliation and denial of paternity proceedings with the focus on a status of the descendants of parties whose rights and obligations may be significantly affected by decisions taken in these proceedings, while their procedural status in a valid and effective legislation does not always proportionately correspond with this encroachment. This may infringe on the right of access to court, as one of the components of the right to a fair trial, of these descendants.
