A duty and a right of a parent and a child on a personal contact

Summary/Abstract: The paper deals with questions related to personal contact between a child and a parent who does not carry out the custody of the child. It analyses the right of a parent to have a contact with his or her child, the obligation of the child to be in a contact with the parent, the right of the child to have a contact to his or her parent and the obligation of the parent to be in a contact with the child. In the context of these right and duties, problems of an interest of a child and a consideration of child’s opinion are reflected. Finally, the paper presents the decision of German’s Federal Constitutional Court about an enforceability of an obligation of a parent to contact with his or her child.
